Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Your Daily Wisdom mobile application (the "App") operated by Your Daily Wisdom ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@teamrileyweb.com if you believe your account has been compromised. We reserve the right to terminate accounts that violate these Terms.

3. Subscriptions and Billing

• Free tier — basic features are available at no charge, subject to usage limits described in the App.
• Paid subscription — premium features require a recurring subscription billed through the Apple App Store or Google Play Store at the rate displayed at the time of purchase.
• Renewals — subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation — you may cancel at any time through your device's App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Price changes — we will give you reasonable advance notice of any price changes. Continued use after a price change takes effect constitutes acceptance.

4. Your Content

You retain full ownership of the voice recordings and any other content you create in the App ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and transmit Your Content solely for the purpose of providing the App's services to you. We do not claim any ownership over Your Content.

You are solely responsible for Your Content. You represent that Your Content does not violate any law or infringe the rights of any third party.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Upload content that is illegal, harmful, defamatory, or infringes any intellectual property right.
• Attempt to gain unauthorized access to our systems or another user's account.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated means (bots, scrapers) to access the App without our written permission.
• Interfere with or disrupt the integrity or performance of the App.

6. Intellectual Property

All rights in the App — including software, design, trademarks, and content we create — are owned by or licensed to Your Daily Wisdom. Nothing in these Terms grants you any rights in those materials beyond the limited license to use the App as described herein.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The App is not a substitute for professional psychological, medical, or therapeutic advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR DAILY WISDOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

9. Indemnification

You agree to indemnify and hold harmless Your Daily Wisdom and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the App, Your Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may terminate your account at any time by deleting it within the App. Sections 4, 6, 7, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through an in-app notice or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
